Welcome to Educators Resource Garden (“we,” “our,” or “us”), operated by NEXUS TECH CONSULTING LLC (“Company”). By accessing or using https://edugardenresources.com (the “Site”) and purchasing or downloading our digital resources, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

1. Digital Products & Delivery

  • All resources sold on this Site (including printables, worksheets, activities, posters, and bundles) are strictly digital downloads (primarily PDF files).
  • No physical goods will be shipped.
  • Upon successful payment through Stripe, you will receive immediate access to download your purchased files, and an email containing transaction details will be sent to your account email. You may also redownload purchased resources through your account dashboard.

2. License & Intellectual Property (Single-Classroom Use)

  • All materials and artwork available on the Site are the intellectual property of NEXUS TECH CONSULTING LLC and its licensors, protected by copyright and intellectual property laws.
  • Permitted Use: When you purchase or download a resource, you receive a limited, non-exclusive, non-transferable Single Classroom / Personal Use License. You may print and use the resources for your own classroom students or personal children.
  • Prohibited Use: You may NOT resell, redistribute, sub-license, upload to public cloud drives (e.g., shared Google Drive, Dropbox, Amazon S3), or share printable files with other teachers, schools, or districts. Multi-classroom or school-wide sharing requires purchasing additional licenses.

3. Refund & Cancellation Policy (Digital Goods)

  • All Sales Are Final: Because digital resources are delivered instantly and cannot be returned, all purchases are non-refundable.
  • Exceptions & Technical Support: If you experience technical difficulties opening a file, receive a corrupted download, or accidentally made a duplicate purchase of the same product, please contact us at [email protected] within 14 days of purchase, with the name on the order and a description of the issue. We will look into it, and duplicate transactions will be refunded.

4. Pricing & Payment

  • All prices are displayed in USD. We reserve the right to adjust pricing, discounts, or bundle offers at any time without prior notice.
  • Payments are processed securely by Stripe. You agree to provide current, complete, and accurate purchase and payment information.

5. User Accounts & Fair Access

  • You are responsible for safeguarding your login credentials.
  • We reserve the right to suspend or terminate access if an account is found engaging in fraudulent chargebacks, automated scraping, or unauthorized file distribution.

6. Disclaimer of Warranties & Limitation of Liability

  • Resources are provided “as is” and “as available” for educational enhancement. While we strive for accuracy, we make no express warranties regarding educational outcomes.
  • To the maximum extent permitted by applicable law, NEXUS TECH CONSULTING LLC shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Site or materials.

  • These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.
